Limited Warranty Terms and Conditions


These Limited Warranty Terms and Conditions ("Agreement") apply to the limited warranty offered by Azure Canada Inc. ("we," "us," or "our") for our products. By using our products, you ("you" or "your") agree to be bound by these terms and conditions. Please read this Agreement carefully.

To activate the full limited parts warranty with Kepler Canada, products must be registered at keplercanada.com. Failure to register will result in a default limited parts warranty of ninety (90) days.


1. Warranty Coverage 

We offer a limited warranty for our products, covering failures resulting from defects in materials and workmanship during normal use and maintenance. The limited warranty terms and conditions are outlined below, with all limited warranty periods commencing from the date of the original installation, start-up, or commissioning of the equipment.

 

2. Warranty Periods
a. A basic limited warranty period of ten (10) years on the compressor and all parts for Kepler® Central Heat Pump, Single-Zone Heat Pump and Multi-Zone Heat Pump to the original registered owner. If the product is purchased from an authorized dealer, a two (2)-year extended limited warranty shall apply, with the total warranty period thereby being twelve (12) years on the compressor and all parts.

b. A limited warranty period of ten (10) years on the compressor and all parts for Kepler® Heat Pump Water Heater to the original registered owner.

c. A limited warranty period of six (6) years on all parts for Kepler® Tankless Water Heater to the original registered owner.

d. A limited warranty period of five (5) years on the compressor and all parts for Kepler® PTAC to the original registered owner.

e. A limited warranty period of ten (10) years on the compressor and all parts of the Midea M134A Series Air Conditioner to the original registered owner. This warranty comprises a seven (7)-year basic limited warranty covered by Midea and a three (3)-year extended limited warranty covered by Kepler Canada. The total warranty period for the compressor and all parts is ten (10) years.

 f. A limited warranty period of ten (10) years on the auxiliary heater to the original registered owner.

g. A limited warranty period of one (1) year on the remote control provided with the original equipment.

 

3. Professional Installation 

This limited warranty only applies to systems that have been professionally installed by a certified and licensed contractor, following all applicable building codes and permits, and installed via Kepler installation and operating instructions.  

 

4. Original Installed Location 

This limited warranty applies to all products remaining in their original installed location.  

 

5. Warranty Voidance 

The limited warranty is void if the product serial identification tag is removed or defaced to a point where the unit cannot be identified.  

 

6. Field Installed Accessories 

Field installed accessories are covered for a limited warranty period of one (1) year from the date of installation.  

 

7. Exclusions 

This limited warranty is not applicable if damage or failure is a result of:

 a. Flood, lightning, fire, wind, or any other acts of nature.

b. Installation in a chemically corrosive environment.

c. Improper matching of product components.

d. Improper sizing or design of the product.

e. Inadequate air supply.

f. Use of components or accessories not compatible with our products.

g. Modification of or incorporation of installation into other products.

h. Power failures, voltage conditions, interruptions, blown fuses, open circuit breakers, or incorrect/inadequate electrical service.

i. Accidents, misuse, abuse, negligence by the contractor or consumer, resulting in property damage, personal injury, malfunction, or failure of the product.

j. Leaky, broken, restricted, frozen pipes, and/or restricted drain lines.

k. Failure to perform routine maintenance as specified in the operator's manual.  

 

8. Refrigerant Replacement 

Any cost to replace, refill, or dispose of refrigerant, including the cost of refrigerant, is not covered under this limited warranty. 

 

9. Proof of Purchase 

Proof of purchase from Kepler Canada must be provided to claim any parts under this limited warranty. 


10. Replacement Parts 

This limited warranty is void if replacement parts are not supplied by Kepler Canada.


11. Excluded Accessories 

Accessories such as condensate pumps, line sets, and others are not covered under this limited warranty. 


12. Electricity or Fuel 

Costs Electricity or fuel costs, or increases in electricity or fuel costs, including additional or unusual use of supplemental electric heat, are not covered under this limited warranty. 


13. Limitations of Liability 

To the maximum extent permitted by law, we shall not be liable for any incidental, consequential, or special damages arising out of or in connection with the use or performance of our products. This limitation applies even if we have been advised of the possibility of such damages.


14. Governing Law 

This Agreement shall be governed by and construed in accordance with the laws of the applicable jurisdiction relating to HVAC systems, without regard to its conflict of laws principles. 

 


15. Severability 

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.


By using our products, you acknowledge that you have read, understood, and agreed to these limited warranty terms and conditions. This Agreement constitutes the entire agreement between you and us regarding the limited warranty for our products.
